Class Action Lawsuits Investigations against Insurance Companies

During an investigation on a farmer’s insurance policy of a client. The class action lawsuit investigator has learned that farmers insurance has been canceling policies of elderly individuals through loopholes. There are types of Life insurance policy premiums that increase as an individual ages and Farmer’s insurance best interest is for a policy to cancel in order to avoid paying for a claim. 

There is a substantial difference between authorizing Farmers insurance to automatically withdraw funds from your bank account for the insurance payment through an ACH transaction and mailing a check for the premium payment. Farmer’s ACH transaction forms are missing many explanations and warnings. For example the ACH program allows for

Farmers to collect the policy premiums quicker and efficiently; However it’s not in the best interest of the consumers. Writing a check the old fashioned way, to Farmers is a much better choice since Farmer’s insurance payment processing systems differ.

Writing a check and mailing it to Farmer’s insurance, can and will prolong a policy cancellation; In case of a premium increase and the insured doesn’t receive the notice. Farmers insurance company negotiates every check payment that comes in through the mail (There are evidence of Farmers payment processing methods). For example, IN A CASE OF A PREMIUM INCREASE; if the payment method with Farmers is to withdraws funds through an ACH transaction and they can choose to NOT withdraw an ACH payment that is less than what a premium increase; And Therefore, a policy will be cancelled within 30 days for nonpayment. (THERE ARE NO DISCLAIMERS ON ACH FORM TO EXPLAIN THAT FARMERS WILL NOT WITHDRAW PAYMENT IF IT’S NOT EXACT PREMIUM AMOUNT). If the insured mails a check to Farmer’s then the payment will be applied to the policy and the rest will be billed as the remainder of premium. This system will Prolong the policy for at least 60 days before the final cancellation. The difference between ACH AND CHECK PAYMENT ARE NOT EXPLAINED BY FARMERS INSURANCE on any of their forms or paperwork.

Farmers insurance has lost a class action lawsuit in the past in regards to unfair business practices of canceling life insurance policies that targeted senior citizens. There are many clients who lost their policies because of farmers unfair business practices and lack of explanations regarding payment processing methods.

IMPORTANT ISSUES THAT ARE FACTUAL

Ehab Hanna Farmers agent Correspondence and emails including phone calls, will prove that the agent Ehab Hannah of Farmer’s Life Insurance has been treating the son, Tamer Farah as the designee since June 8, 2014. Hannah never met or spoke with the insureds Nagy and Teresa Farah. Tamer was the only contact and there was no reason for the insured or Tamer to believe that he was not the designee for Nagy Farah. Furthermore, Hanna has failed to notify Tamer of the policy cancellation. Furthermore, Hanna has mailed a notice of reinstatement directly to Tamer’s correct home address that Farmers has failed to notify of the cancellation. Hanna seems to have a thriving practice and is overloaded with policies. In July, 2017, Tamer called, the agent Ehab Hanna to check on all policies including his parents policies and Hanna advised Tamer that the policy has been canceled due to insufficient funds. Tamer called Farmers life insurance on August 2, 2107 and was able to discuss the policy cancellation and he was advised to file out a reinstatement application with a payment of $1,174.17; Tamer complied as instructed. Again Tamer had no reason to believe that he wasn’t the designee for Nagy Farah. Farmer’s Life Insurance was always paid through an automatic ACH transfer from Tamer Farah (NOT Nagy Farah) bank account since 2014. This means that Farmer’s Life Insurance was receiving payment automatically through “ACH” the Automatic Clearing House system. In 2015, Farmers increased the premium from $218.00 to $242.00. Farmers automatically withdraw the increased premium of $242.00 from my Bank Account and Farmers didn’t require or request for me to sign an ACH authorization for the increased payment. A letter from Farmers dated, November 14, 2016 indicated Nagy Farah policy entered the grace period on November 11, 2016. However, November 15, 2016; Tamer bank statement indicates an, EFT draft of $242.00 from Farmer’s life insurance was transacted. Farmers processed and received a payment of $242.00 via ACH; without any consent or prior authorization from Tamer or the insured Nagy Farah• Farmers had the authority and ability to withdraw the increased premium amount as they have previously done. Farmers intentionally choose NOT to withdraw the funds to cause a policy cancellation.

2. FARMERS ACH Fraudulent and discriminative acts AND POLICY INCREASE ISSUES Farmers insurance has discriminated against Nagy Farah because of his ethnicity, age and sex that increased the risk of death. Farmers had discriminated against Nagy Farah. In support of the discrimination and without a doubt. In 2015 Farmers automatically withdraw the increase amount in premium via ACH from Tamer Farah personal bank account and without any written authorization. In January 2017 when a premium increased Farmers deliberately stopped withdrawing the ACH funds because of their discriminative intent to cancel the policy because of the insured’s ethnicity, age and sex. However, November 15, 2016; Tamer bank statement indicates an, EFT draft of $242.00 from Farmer’s life insurance was transacted. Farmers processed and received a payment of $242.00 via ACH; without any consent or prior authorization from Tamer or the insured Nagy Farah• Farmers had the authority and ability to withdraw the increased premium amount as they have previously done. Adnan; I BELIVE YOU STATED THAT IS A FEDERAL LAW PROHIBITING DISCRIMINATION. Agent Ehab Hanna told Tamer that the policy was canceled because of insufficient funds; Which was not true, Tamer has an average balance of $3,000. Hanna knows how Farmers operates; And Farmers insurance normal practices to automatically “ACH” withdraw an increased premium amount without the insured’s consent. Important legal points to consider Farmer’s Life Insurance did not at any time mention a statute of limitation and he continued to send three renewal notices between 2018 and 2019. Therefore I don’t believe the two-year statute of limitation would apply in this case. Farmer’s Insurance mailed out several renewal letters with applications to renew the life insurance policy; July, 2017, December 2018, and February, 2019. Maybe you can explore Farmers incompetence and system failure. A translated letter from the insured Nagy Farah requested a copy of the insurance policy in the Arabic Language since Nagy didn’t understand English and the insurance policy. The letter was translated and mailed by Michael Youssef and Farmers has replied; without addressing the policy translation. Common Law After a thorough review and investigation into this case the following; I have concluded that the following statements of facts are true and correct. Farmers insurance has the ability to object and address to the following statement of facts. 1. Tamer Farah is the designee for Nagy Farah life insurance policy since June 8, 2014; Since Farmers Agent Ehab Hanna never met the insured and has always shared confidential insurance policy with Tamer Farah via phone calls, emails and U.S. Mail. 2. Farmers insurance had the authority and ability to ACH withdraw the policy premium of $242.00 and has intentionally declined to withdraw the funds causing the insurance policy to be cancelled. 3. Farmers had failed to notify Tamer Farah of the life insurance policy cancellation. 4. Farmers insurance payment processing system including ACH payment instructions integrity is questionable, and in need of an overhaul since Farmers have mailed out 3 letters of policy reinstatement and recanted; Claiming that it was a system error. 5. The policy cancellation is due to Farmers repeated errors, systems failures, lack of ACH withdraw instructions, ACH payment rule changes in the best interest of Farmers Insurance and not the insured. 6. Farmers insurance legitimately owes the policy premium of $75,000 with interest and attorney fees and costs. Farmers Insurance and Agent Ehab Hanna have 30 days from receipt of this letter to address or object to the following statements of facts 1 through 6. Otherwise a lack of response will be considered as an admission to the statement of facts 1 through 6. Therefore, the statements of facts will be admissible in a court of law as evidence of admissions by Farmers insurance and Ehab Hanna.
