Summary Jury/Bench Trial is a non-binding process where the parties present synopses of their cases to a mock jury or a judicial officer and use their decision to resolve the conflict. Before the trial, all materials pertaining to the case should be submitted. All parties, or their representatives, and their counsel must be present at the trial. Six jurors review the materials submitted and make their decision in a day or less. The Court may question members of a jury panel or determine whether to allow challenges. Each party makes a brief opening statement which may be recorded at the party’s expense. The record may not be used as evidence in any subsequent trials. Counsels present a summary of the case, including opening statements, production of evidence, and final arguments. The judge gives the jury instructions, and the jury makes a decision. If the conflict is not resolved s the result of the jury’s decision, it should proceed to full trial on the scheduled date.
ENE – Early Neutral Evaluation
Early Neutral Evaluation (ENE) is a pretrial procedure where a neutral evaluator meets with the parties at the beginning of litigation process and assist them with organizing discovery, preparing the case for trial, and resolving of the conflict. The main role of the evaluator is to assess legal and factual aspects of the conflict and estimate the value of the case.
The duties of the neutral at the Early Neutral Evaluation procedure are as follows:
– Allow each party to make a brief oral statement outlining their position.
– Assist the parties with identifying areas of agreement and entering stipulations on the court record.
– Determine the parties’inclination to negotiate.
– Assist the parties with identifying issues that make up the conflict.
– Identify strengths and weaknesses of the parties’ positions.
– Encourage the parties to make an agreement on an information exchange and discovery.
– Assist the parties with litigation cost assessment.
– Determine the necessity of additional conferences, schedule conferences, and assist with preparation of the necessary materials.
– Evaluate the parties’ strengths and weaknesses and the probable outcome of the trial.
– Upon the completion, report the result of the evaluation to the ADR Administrator.
