However, some courts apparently still require the original POS, and several investigators had a copy of their POS rejected by certain courts. Several individuals said that they provide their client with both the original and copy, at their client’s request. Several others said that they email the copy and, if their client requests the original, they will send it. Someone has the process server fill out the POS and sign it in blue ink and then sends a (color) copy of the POS to their client, which looks like an original.


In conclusion, even though there are different opinions and approaches to this issue, the most logical approach is to ask your client if they simply need the original. They may not, since it’s an extra piece of paper that they may not have a physical file to put it in. However, you may want to have the original copy saved in your office, in case a court requires the original.
